Which is better for me to do for my Jerseys Rants monkier ? It's a dumb question really but.. I'd like to pick the brains who know from the Peanut Gallery..

Anything you write or create is automatically copyrighted. But that is the work as a whole.

A name or term/phrase must be trademarked or servicemarked in order to be legally protected.

We've been working for the past 2 years to get a trademark registered... then again, we had to wait for someone elses registration to drop on the mark before we could file.

"Jersey Rants" would be a trademark. It's a fairly lengthy process but it's a good idea especially if you're going to make a real go of that. Attorney's can be real useful here as they have experience with it and can guide you. I did mine by myself at http://www.uspto.gov/. Follow the steps and it's not so bad at all. If I remember correctly I think it took me 18 months or so.

Get the Trademark - on the 'Jersey Rantz' - images and writing automatically hold copyright if you create them so that is a much smaller task.

From the USPTO faq's page (http://www.uspto.gov/faq/trademarks.jsp)

"For a trademark registration to remain valid, an Affidavit of Use ("Section 8 Affidavit") must be filed: (1) between the fifth and sixth year following registration, and (2) within the year before the end of every ten-year period after the date of registration. "

Look at how much it's going to cost and how long it will take and decide if it's worth it.

If you garner an audience and then some other twat comes along and trademarks it to try and steal your popularity then you just change it to Meathead Rants and then make a big deal about the underhanded trademark registration which might get you even more exposure.
