[03] UNACCEPTABLE USES OF LICENSED CONTENT

Images may not be used as free content for affiliates in a sponsorship program, hosted galleries for affiliates in a sponsorship program, or any other use that allows anyone other than Licensee to use the images. A special license is available for this purpose.

Now I would suspect that section stands out pretty well if you bother to read licenses. A lot of people don't apparently.

Anyone have contact info for JenC from PhatBucks? Thanks.

I'm sure our producers would, too. NOTHING waters down the value of content like using it in FHG's. That's why it's a special rate with a special license. So it doesn't become worthless to our customers.

I always read them when I owned my content company I had to deal with tons of people not reading the liscense

I hate when people don't read licenses/terms and conditions. They're there for a reason.

Always good to go back and refer to the license again when doing a new project with content. There aren't really any content companies that allow their content for use with hosted galleries without a special license, with good reason. I believe Paul Markham's bargain basement content does, however it's already pretty watered down, hence the reason for the rock bottom prices.

I always read them
my problem is getting the signed licence back to the content seller.

I still have a few to mail out, I just keep forgetting to do that.
maybe today, I will go get them out.

I always at least skim a license when I buy content.. it's a thing that carrys over from my speed reading courses in school. If something stands out like the paragraph you mentioned, it sticks with me. However, if I am using the content for something I feel could be questionably, I will ALWAYS pull out the contract to be 100% sure I'm not breaking the rules. Better to be safe than sorry. :)

Hey Jact.....I actually already knew you didn't allow your stuff to be used for hosted galleries as I've seen you post it on here before. So when I pick out stuff to use for hosted galleries, I make sure to disclude your stuff.

HOWEVER I did have a partner that used to make our hosted galleries for us and I wouldn't be too shocked that he might have used something of yours. Please just login to Phat Bucks and look at all of our galleries and tell me which ones are yours.

Not to be a fly in the ointment, but as a program owner, shouldn't you know what content is in your FHG? :confused:

Yes, I read the license. I usually try to only buy from sites that have a pretty open license since I like some leeway in what I do with my content. I also try to buy free content rights to most nonexclusive sets I buy, even if that means I have to pay extra for full resell rights.

Some sites I won't buy from until I e-mail them and see if they'll modify their license for my needs. Worldwide Content is a good example.

Actually..here's a question, since I do have to buy some very soon, how much more expensive is the rights to use content in FHG? I mean ballpark?

As I don't like doing it, $1 per image (For the set, not $1 per image you're going to use in the gallery) and we ask that you don't select sets under 50 photos.

But this has me thinking, what are we protecting and for who?

I'm starting to think it's not in my interest to protect my clients content, because when it's sold that's who I'm protecting. Yes they all want sets that are less distributed, but they want to pay the same money or less.

Two weeks ago, we put up a section of semi-exclusive sets, were going to do videos, which gave the buyer the option of buying sets that would be sold 5 or 10 times at a slightly increased price.

To date out of the 3 sets available and 20 licenses we have sold two licenses in two weeks, on this set. A set that if I put it out as normal I would sell 20 minimum.

When it comes to hosted galleries, affiliates, etc. Am I protecting 10 clients and and turning away 20 who would buy if they could give content to affiliates.

If paysite owners want to flood the Internet with my content then fine let them. I'm after sales to the many, because it seems selling to a few is not wanted, unless it comes for free.
